SMP Update legal issues forum (video).

Fifty shoreline homeowners attended our meeting on March 9th. Attorney Dennis Reynolds joined us for a discussion of the legal issues surrounding the city’s Shoreline Master Program update, currently under way. We recorded the presentation for those who couldn’t attend. You may view the videos below.

Part One: About Dennis Reynolds
Dennis introduces himself and explains how he gained so much knowledge and experience with Washington State’s environmental regulations.

Part 2: About the Shoreline Management Act
Dennis talks about Washington States Shoreline Management Act and how it has been interpreted by the state’s Department of Ecology, local planners and the courts.

Part 3/4: Shoreline Management Program Update Issues
Dennis discusses his experience with SMP updates in Jefferson and San Juan Counties, and suggests best practices for participation by affected property owners on Bainbridge Island.

Part 5: The Scary Part
Dennis outlines a legal strategy being used by attorneys representing the City of Bainbridge Island that claims shoreline homeowners have no property rights.

What’s so scary? The City of Bainbridge Island says shoreline homeowners have no “property right” to apply for or construct a dock. See their argument below…

    Very nice and informative meeting with Dennis R. It is so important that the message at the meeting be made clear to COBi city council. That is: Council should make policy, staff should implement the policy. It does seem that the staff is running the show and that council is bewildered and just lets things run wild.

    I doubt that the council members really have a grasp of the impact that such regulations create for shorefront owners and their families.

    WOW! Shoreline owners everywhere need to start paying attention. I’m sure they don’t realize what is happening. Kitsap County needs to come together with property groups and come up with a reasonable plan. I’m all ears! I can’t imagin 30K people (just a guess) loosing their homes. Come on County work with those people effected. This is BIG. A greatful thanks to Dennis.

    This is a great primer in understanding what is going on with our shorelines. This presentation is about the City of Bainbridge Island but all shoreline property owners are facing the same threat of government take-over via regulations. Knowing the history as Dennis has presented it here and how the Shoreline Management Act is being (mis)interpreted by regulators is important if we are to effectively protect not only the use and enjoyment of our property but the environment and the shoreline. Knowledge is power. Wonderful presentation, Dennis. Thank you so much. Vivian Henderson

    This is important….. the last couple of videos were really amazing….. the last one truly scary. but all important to read and pass along.
